AGREEMENT TO REPRESENT
BUYER 1)
In
consideration of this Agreement to enlist and use on an exclusive basis the
efforts of PRUDENTIAL CRES COMMERCIAL
REAL ESTATE, a Licensed Real Estate Broker, hereinafter referred to as
Broker to secure for ________________ hereinafter
referred to as Buyer the Property described below.
Prudential CRES Commercial Real Estate shall act in the capacity of a
Transaction Broker. Buyer does
hereby grant Broker a period of one year (365) days from this
date, the Exclusive Right and Authority to represent Buyer in his search
for the Property, described as:

In the event Broker secures a Property which meets Buyer's criteria and
subsequently results in an offer for Buyer to purchase said Property, Broker
will be entitled to negotiate this offer in Buyer's behalf and receive as
compensation for his efforts any commission that can be successfully negotiated
with the Seller of the said Property. Buyer
shall not be obligated for direct compensation of Broker, for his efforts in
anyway. 3)
Buyer agrees to inform Broker of all Properties which meets Buyer's
criteria listed above that have been brought to Buyer's attention by a third
party as being for sale or that Buyer may have an interest in purchasing. 4)
(Optional) Notwithstanding the above, this Agreement may be canceled at
any time after the first 180 days of the Agreement term with ten (10) days
written notice to the Broker. 5)
Buyer and Broker acknowledge that this Agreement does not guarantee the
location of a suitable Property for Buyer nor does it guarantee that Buyer will
purchase Property submitted to him by Broker that meet his criteria.
There are no other Agreements, promises or understandings between Broker
and Buyer, either expressed or implied other than specifically set forth herein.
In connection with any litigation between the parties arising from this
Agreement, the prevailing party shall be entitled to recover all costs incurred
including reasonable attorney's fees through appeal.
